1. Parties and acceptance

These terms are an agreement between you and (“we”) on the use of the CANDIAG app, the portal, the website and our server (together, the “service”). By registering, signing in, paying for an order or otherwise using the service, you confirm that you have read and accept these terms and the privacy policy. If you act on behalf of an organisation, you confirm that you are authorised to accept these terms on its behalf.

2. The service

• The Android app works with a diagnostic adapter and runs vehicle software;
• the portal and the server provide your account, adapters, purchases, diagnostic history and support requests;
• vehicle software is original software of its manufacturer. We provide access to it and the environment it runs in; we do not write or modify it. The right to use vehicle software is granted for the adapter named at purchase, for the period and scope shown at purchase; all exclusive rights remain with their holders.

3. Your account

• An account is for one person. Do not share your password or confirmation codes and do not use someone else’s account;
• you are responsible for actions taken under your account and for the accuracy of the details you provide;
• if you suspect someone else has accessed your account, change your password and tell us.

4. Adapters

• Purchases tied to an adapter apply to the adapter with the serial number named at purchase;
• handing an adapter over to another person and moving purchases between adapters is possible only under the service’s rules in force at the time; you cannot move a purchase to another adapter yourself;
• an adapter that fails verification or is on the blocked list may be refused.

5. Purchases and payment

• The price, contents, period and the adapter a purchase applies to are shown before payment. The subscription period is fixed at the moment of purchase and does not change if prices or offers change later;
• payment is made on the payment provider’s page; we never receive your card details. Access opens once the payment is confirmed;
• 30-day refund: within 30 days after a subscription is issued you may cancel the order for any reason and get the full amount you paid for it back, as long as the subscription period has not ended yet. The money goes back to your balance or to the payment method you used, where that method allows it; our support team processes the refund;
• after 30 days and until the end of the subscription period an order cannot be cancelled and is not refunded, except where applicable law provides otherwise — only a transfer of the subscriptions to another device of yours is available, with a stated reason (for example, the device has failed or been lost); the periods stay the same;
• when access ends (the period expires or the order is cancelled), the vehicle software stops opening until access is restored.

6. Dealers

Purchases may be placed through a dealer or a sub-dealer. An order that staff or a dealer placed for you at your request is paid at your cost and becomes your purchase. Any terms a dealer offers beyond these are an arrangement between you and the dealer.

7. Safety of vehicle work

• The service is intended for qualified professionals. Follow the vehicle manufacturer’s procedures and safety rules;
• operations on control units — coding, programming, adaptations, resets, actuator tests, writing data — are performed at your command, and you are responsible for performing them and for their consequences. Before such operations, ensure a stable vehicle power supply and a stable connection to the adapter;
• the service does not replace your professional judgement: diagnostic results need to be checked by a professional.

8. Prohibited use

• decompiling, disassembling or otherwise reverse engineering the app, vehicle software or the adapter, except where applicable law expressly allows it;
• circumventing licence, adapter or app verification or other protection measures, copying or distributing vehicle software;
• using someone else’s adapter or account without their owner’s consent;
• performing immobiliser or key operations without a lawful right to the vehicle and without any authorisation the law requires;
• using the service for anything unlawful or anything that disrupts it.

9. Updates and availability

We keep developing the service: features, vehicle software and supported adapters may change. We aim to keep the service running without interruption but do not guarantee constant availability: maintenance breaks, connection failures and third-party outages may occur.

10. Disclaimer and limitation of liability

To the extent permitted by applicable law, the service is provided “as is”: we do not guarantee that it suits a particular vehicle or task or that it is free of errors. To the same extent, we are not liable for indirect losses, lost profits or the consequences of vehicle operations performed at your command. Rights that applicable law gives you as a consumer and that cannot be limited by agreement are not limited by these terms.

11. Suspension and termination

We may suspend or end access to the service if these terms are breached, if the security of the service or other users is at risk, and in cases provided for by law. You may stop using the service at any time. Your account is not deleted when you do — payments, device licences and purchase history depend on it; how we handle data is described in the privacy policy.

12. Changes to these terms

We may change these terms. The new version is published on this page with a new date; by continuing to use the service after it is published, you accept it. We try to announce material changes in advance.

13. Governing law

These terms are governed by the law of: . Disputes are settled by negotiation and, failing that, in the manner set by that law, without prejudice to the rights the law of your country of residence gives you as a consumer.

15. Third-party data

To determine the country of a visitor or a sign-in, the service uses an IP geolocation database. This product includes GeoLite2 data created by MaxMind, available from https://www.maxmind.com.
